Terms and Conditions & Rental Agreement
Through the Services, we aim to give you access to luxury ski wear and accessories, and other content to help you feel your best.
Definitions
In these Terms of Use “you” and “your” refer to all users of this Website and account; and “we’, “us” and “our” refer to The Ski Closet. References to users must be read as being also a reference to customers or content creators of The Ski Closet.
LEGALLY BINDING Contract.
These Terms of Use constitute a binding legal contract between you and The Ski Closet. These Terms of Use apply to you whether you are browsing or are a customer of The Ski Closet. The Terms of Use in force at any time are published on this Document and you will be taken to have accepted them by booking an item through our website or Instagram and/or making payment of a bond with The Ski Closet. If The Ski Closet develops revised terms of use then on this Document they will supersede those they replace. If you subsequently rent an item you will be taken to have accepted the revised terms of use. If you do not agree with the terms of use do not rent an item from The Ski Closet. These Terms of Use may change without notice, so do check from time to time. If you do not agree to any change, you should not rent an item from The Ski Closet.
This agreement contains all of the terms and conditions regarding your rental of products from The Ski Closet via our website, Instagram and accompanying booking platforms. You agree that rental from our business is subject to all terms and conditions and privacy policy. These are available via this Document and are subject to change from time to time. You agree that you are renting products and ownership of the product remains with The Ski Closet at all times.
On the basis of collaborating with The Ski Closet as a content creator you agree to adhere to this rental agreement as if you were a client whom was renting an item/s, instead providing content in return as payment.
Our Commitment to you
We will deliver the product that you have ordered including the correct size, colour, and style on or before the date you have specified for delivery on your order. Except where we have indicated to you that your request for this is not possible or guaranteed and therefore your order has been amended. Products may appear different in colour and style then the images listed on our website and/or Instagram. Our liability to you for failure to deliver a product you have ordered is limited only to timely delivery.
Required from you
At the time of booking and securing your rental item/s it is required that you provide the following information:
The Ski Closet reserves all rights to request aforementioned information/details and by agreeing to these terms you agree to this.
Payment Terms
The “rental fee” for the products will be the rental fee, dry cleaning fee and delivery fees and any additional charges discussed in relation to your rental of products. When you rent an item from The Ski Closet payment options include, but are not limited to bank transfer, cash and card transaction. A $200AUD bond is required on each item used for content creation, unless otherwise agreed. In addition to the cost of your rental order for an item/s, a $200AUD bond is required per item, unless otherwise agreed.
Delivery
Private delivery of your order is arranged between The Ski Closet and you as the client. This is a service offered for no cost by The Ski Closet, unless stipulated prior to delivery. The time of delivery may vary and is dependent on a mutually agreed time. We endeavor to deliver your item/s at the requested and agreed time, however we agree to notify you of any delays in real time. The location of delivery must be mutually agreed to, by The Ski Closet and you.The location of delivery must be provided and mutually agreed to at least 2 hours prior to the agreed delivery time. If a location is not provided and agreed to prior to 2 hours of the delivery time, you agree that this may affect the delivery time of your order and; the order may not be fulfilled until another mutually agreed time or the order being cancelled by us. A collection date and time must be adhered to by you. If return postage has been mutually agreed to, the below conditions will instead apply.
Shipping Details and Information
Delivery Australia wide is available and the shipping method will be the choice of The Ski Closet. Your delivery can be delivered to you, up to 6pm on the requested day of delivery or earlier. Once delivery has been made to your nominated address you bear all responsibility for your product. If you have opted to have your product delivered to the mailroom of your work address, responsibility is passed to you as soon as the mailroom has signed for the product. A secure shipping address is highly recommended when placing your order. In the event that an unsecured shipping address is provided The Ski Closet does not bear any responsibility for the product left unattended. If you are unavailable to receive the item The Ski Closet will not be held responsible for additional shipping delays or additional shipping charges passed on by delivery service. The Ski Closet will not take responsibility for lost packages mailed in Australia post boxes.
WARNING: If you are unavailable to sign for this delivery it may be taken back to the depot or post office for collection by you. It is your responsibility to be available for delivery of your item/s or collection of your item/s when you have not been available. Your rental period starts from the time the courier attempted first delivery and credits will not be issued for late delivery where you have not been available to accept delivery. If postage delays are outside our control (mutually) we agree that you and The Ski Closet will not be accountable and a store credit will be issued.
With the delivery of your item/s, pre-paid return packaging is provided to each customer, unless a prior arrangement is mutually agreed to.The rented item/s must be posted back to The Ski Closet on the last day of the selected rental dates, prior to 4pm. Proof of postage must be provided to us via email and/or Instagram within 4 hours of this being actioned. If you return your product late you will incur a fifty dollar ($50.00 AUD) late fee for every day you are late up to 100% of the retail value of the item/s in full. The amount payable to us, by you is at the discretion of The Ski Closet and may include but is not limited to collection and legal fees endured by us to obtain the aforementioned payment. You agree to pay us these late fees up to an amount not exceeding 100% of the retail value of the item/s less the rental fee, already paid by you.
If you lose your return packaging it is your responsibility to return the item/s via trackable express post to The Ski Closet. You must purchase return shipping at your own expense and provide the tracking number to The Ski Closet.If you lose your packaging it is your responsibility to return the product to The Ski Closet within one (1) business day of return date.You must provide the updated tracking details to The Ski Closet via email and/or Instagram within 4 hours of receiving the new postage details in order to avoid further rental charges. The Ski Closet will not be held liable for products that are late or lost in transit due to your chosen method of shipping.
If you return your item/s via an Australia Post Outlet (highly recommended) where it will be scanned over the counter as proof of lodgement then the package will be deemed as returned and we will accept responsibility for the package after the first scan. If you return your item/s via an Australia Post Box and/or the item/s is not scanned and is lost by Australia Post then you accept responsibility for this loss and will be required to make payment to us up to 100% of the retail value of our item/s in full. The amount payable by you is at the discretion of The Ski Closet and may include but is not limited to collection and legal fees endured by us to obtain the aforementioned payment. You agree to pay these fees up to an amount not exceeding 100% of the retail value of the item/s, less the rental fee already paid by you.
Late and Non Returns
Late fee is payable by all customers regardless of whether a customer is a member, content creator or has used credit for their order. You agree to return your product on the order return date by 4pm, using the prepaid return envelope provided. If you are late to return an item/s, you are required to notify us within 48 hours of your final rental date. If you return your product late you will incur a fifty dollar ($50.00 AUD) late fee for every day you are late up to 100% of the retail value of our item/s, at the discretion of The Ski Closet. You agree to pay these late fees up to an amount not exceeding 100% of the retail value of the products. If you have not returned your product within 15 days of the return date your product will be considered a non-return and The Ski Closet will demand payment for the maximum late fee and RRP item price as set above, less any late fee we have already charged you.
Collection
If you do not pay the amounts owed to us when due we will pass on the invoices to a collection company to pursue you for collections, including and without limitation legal and collection fees. The Ski Closet reserves the right to terminate your right to rent products from us at any time at our own discretion should you breach this agreement or for any other reason.
Product Fit and Returns
If a product does not fit you then you can return it unworn within 24 hours to receive a credit of the rental fee minus delivery charges. You must Instagram Direct Message and/or email The Ski Closet with in 24 hours indicating your intention to mail back the product for credit. The term “unworn” will be determined by The Ski Closet and must be fulfilled prior to a credit being issued. Credits will only be issued if ALL of the sizes in the order were unworn.
Dry Cleaning
We dry clean and inspect all products with the utmost of care. However, use of this product is at your own risk and The Ski Closet shall not be held liable for any health-related complaints associated with a product hired from our website and/or Instagram. Our products have been worn by other consumers prior to your rental.
Use of The Ski Closet products
You agree to treat our products like you would your own. You will treat the garment with the utmost of care. You will not attempt to fit into an item that is too small for you, you will not try to zip up an item that is too tight and therefore damage the zip. You are responsible for any damage to the skiwear inclusive but not limited to the following; fire, major stains, theft or loss. Normal wear and tear is considered to be minor stains which are successfully removed in dry cleaning, small seam rips, stuck zippers. If you return a product and it is damaged beyond normal wear and tear and a stain not able to be removed then you agree that we shall charge you, and you will pay, for the price of repairing the item. If the item is unable to be repaired, you agree to pay up to 100% of the retail value of the item/s. This price will be at the discretion of The Ski Closet. The refund of your bond will not occur until the inspection of the garment is successful and complete. Upon the successful repair of the damaged product, you will receive an amended refund amount of the bond, less repair costs. The Ski Closet will return your bond upon successful repair/dry cleaning efforts. The returned item/s will be inspected by The Ski Closet within 48 hours upon the return. We will notify you within 48 hours of receiving the item/s of the outcome of the inspection.
Collection

Cancellation Policy
Hire fees are non-refundable. If you cancel your hire and give us 2 weeks notice, then we can happily issue you a credit note to be used within 3 years from the date of cancellation.
Fit
If the skiwear is not your perfect size, we will try our endeavour to provide an alternative style or size (subject to availability and courier service availability) must be within the Express network and dependent on a confirmation from Australia Post)). If we are unable for whatever reason to send an alternative size or style a merchandise credit will be issued for the customer to the equivalent value of the rental.
By paying the required deposit you agree to the above terms and conditions.
